Privacy Policy

This Privacy Policy applies to personal data processed by Akaya through or in connection with the Akaya mobile application, website, AI companion, voice features, kundli report features, subscription features, customer support, and related services together referred to as the "Application" or "Service."

For the purposes of applicable Indian data protection law:

• Akaya Astrotech LLP is the Data Fiduciary that determines the purpose and means of processing your personal data.
• You are the Data Principal, meaning the individual to whom the personal data relates.
• Our service providers that process personal data on our behalf are Data Processors.

This Privacy Policy does not apply to:

• third-party websites, applications, or services that you may access through links from the Application;
• information you provide directly to third parties outside Akaya, such as a payment processor; or
• information you choose to share publicly or with other people outside the Application.

Third-party services are governed by their own terms and privacy policies. We encourage you to review them before using those services.

We collect personal data directly from you, automatically when you use the Application, from service providers that help us operate the Application, and from third-party sign-in or payment services where you choose to use them. We do not intentionally collect more personal data than we need to provide and operate the Application.

Account Information

When you create or use an account, we may collect name, email address, phone number if applicable, login credentials or authentication information, account identifier, profile preferences, language settings, notification settings, and other information you choose to add to your account. If you sign in using a third-party account, such as Google sign-in, we may receive basic profile information from that service, such as your name and email address, in accordance with that service's permissions and privacy policy.

Birth Details

To generate your astrological profile, kundli, and readings, we ask you to provide your date of birth, exact time of birth, and place of birth. These details are core inputs for Akaya's astrological computation engine. Because precise birth details may be personal and identifying when combined with other information, we treat them with heightened care. Where feasible, Akaya may use derived astrological chart information rather than raw birth details for AI-assisted interpretation.

Kundli, Chart, and Reading Data

When you use Akaya, we may generate and store your natal chart or kundli, astrological placements, derived chart attributes, generated readings, report summaries, remedy suggestions, saved insights, follow-up questions and answers, and other outputs generated through the Application, associated with your account so we can provide reading history and personalize your experience.

AI Chat Inputs and Outputs

You may interact with Akaya's AI-assisted tools by submitting questions, prompts, and other text ("Inputs"). Akaya may generate readings, insights, responses, and other content in response ("Outputs"). We may store your Inputs and Outputs to provide the Service, maintain your conversation history, personalize your experience, improve reliability and safety, debug errors, respond to support requests, and comply with legal obligations. Please avoid submitting information that is not necessary for your reading, including government identification numbers, financial account numbers, passwords, medical records, emergency information, or personal data about other people.

Voice Features

If you use voice features, we may process your audio input to understand your question and generate a response. This may involve converting your voice input into text, processing the resulting transcript, generating a response, storing the transcript as part of your chat history, and temporarily processing audio for functionality, quality, safety, or debugging. Unless clearly disclosed to you, we do not use your voice to identify you, create a voiceprint, or perform biometric identification.

Subscription and Payment Information

Akaya may offer paid plans. Payments may be processed by a third-party payment processor, such as Stripe. We do not collect or store your full card number, UPI credentials, bank account details, or equivalent payment credentials unless expressly stated. We may receive limited payment-related information, such as subscription status, plan type, billing country, payment success or failure status, transaction ID, invoice information, last four digits of a card where applicable, and payment processor customer ID.

Information Collected Automatically

We may collect usage information (features accessed, screens viewed, session timestamps, error logs, crash reports, diagnostic data, interaction patterns) and device and technical information (device type, model, operating system, browser type, app version, language settings, IP address, general network information, device identifiers used for security, analytics, or functionality). We may infer your approximate location, such as city, region, or country, from your IP address. We do not use this information to build advertising profiles about you, and we do not collect precise live device geolocation unless a specific feature requires it and we provide notice or obtain consent where required.

We do not collect biometric information for identification. The Application does not use facial recognition, photograph analysis, palmistry scanning, body analysis, fingerprinting, retina scanning, voiceprint identification, or any similar biometric identification feature. If Akaya introduces any feature involving biometric processing in the future, we will provide appropriate notice and obtain consent where required before enabling that feature.

To provide the Application: we use personal data to create and manage your account, generate your astrological profile, kundli, chart, and readings, produce AI-assisted responses, provide chat and voice companion features, maintain your reading and conversation history, personalize your experience, manage your subscription, send service-related communications, and respond to support requests.

For security, safety, and operational purposes: to operate, maintain, and secure the Application; detect and prevent fraud, abuse, and unauthorized access; investigate security incidents; fix bugs; monitor performance; verify your identity when you exercise rights; enforce our terms; and comply with legal obligations.

To improve the Application: to understand how users interact with it, test and improve features, and improve safety, reliability, and the clarity and quality of readings. Where practical, we use aggregated or de-identified information for product improvement.

With your consent, and for certain legitimate uses permitted by law: where consent is required we will seek it, and you may withdraw consent where applicable; withdrawal will not affect the lawfulness of processing done before withdrawal. Where Indian law permits certain processing without separate consent, we may process personal data for such permitted purposes.

Akaya uses artificial intelligence technologies, including large language model technology provided by third-party service providers, to help generate readings, insights, summaries, and responses. Our current or intended AI service providers may include providers such as Anthropic, Google, or other infrastructure and AI service providers used to operate the Application.

To generate an Output, Akaya may process your question or prompt, relevant conversation context, your derived chart or astrological profile, your birth details where necessary, reading history where needed for continuity, and safety or system instructions. Where feasible, we aim to reduce the personal data sent to AI providers by using derived astrological chart information rather than raw birth details.

We do not use your personal data, birth details, Inputs, Outputs, voice transcripts, or reading history to train, fine-tune, or otherwise develop Akaya's own AI models or any third party's AI models. We use contractual and technical measures designed to restrict providers from using your personal data for their own independent purposes, including model training, except where you have expressly consented or where applicable law permits or requires otherwise.

AI-generated Outputs may not always be accurate, complete, or appropriate for your situation. Akaya's Outputs are for self-reflection and general-interest astrological guidance only.

Akaya is designed as a subscription-led and trust-first service.

• We do not sell your personal data.
• We do not display third-party advertising inside the Application.
• We do not use your personal data to build advertising profiles about you.
• We do not share your birth details, chat content, readings, or emotional/self-reflection inputs with advertising networks.

If our business model changes in a way that materially affects how your personal data is used, we will update this Privacy Policy and seek consent where required by law.

We may disclose personal data to service providers that process it on our behalf and under our instructions, including cloud hosting and infrastructure providers, database and storage providers, AI and LLM providers, speech-to-text or text-to-speech providers, payment processors, email and communication providers, customer support tools, analytics and diagnostics providers, security and fraud prevention providers, and legal, accounting, tax, and compliance advisors. These providers may process personal data only for the purpose of providing services to Akaya, subject to contractual obligations and applicable law.

When you subscribe or make a payment, your payment information may be processed directly by payment processors governed by their own terms and privacy policies. Akaya does not store your full card number, UPI credentials, bank account details, or equivalent payment credentials unless expressly stated.

We may access, preserve, or disclose personal data where necessary to comply with applicable law; respond to lawful requests from courts, government authorities, regulators, or law enforcement; enforce our terms; detect, prevent, or address fraud, abuse, security incidents, or technical issues; protect the rights, property, or safety of Akaya, users, or others; or establish, exercise, or defend legal claims.

If Akaya is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction, personal data may be disclosed or transferred as part of that transaction. Where required by law, we will notify you of material changes. We may also disclose personal data where you direct us to or otherwise consent.

Akaya is operated by an India-incorporated entity. However, some of our service providers, infrastructure providers, AI providers, support systems, or technical teams may process personal data in countries outside India. Your personal data may therefore be transferred to, stored in, or processed in countries other than India.

Where personal data is processed outside India, we take steps designed to protect it in accordance with this Privacy Policy and applicable law, including by using contractual obligations, access controls, security measures, and vendor review processes. We will comply with applicable Indian legal requirements relating to processing or transfer of personal data outside India.

We implement reasonable technical and organizational measures designed to protect personal data against unauthorized access, disclosure, alteration, loss, misuse, or destruction. These may include encryption in transit, encryption at rest for sensitive stored data including birth details where technically feasible, access controls, authentication controls, logging and monitoring, role-based access restrictions, security review of service providers, internal confidentiality obligations, vulnerability management, backup and recovery controls, and incident response procedures.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials and for using a secure device and network. If you believe your account has been compromised, please contact us immediately using the contact details below.

If we become aware of a personal data breach, we will take steps to assess, contain, investigate, and remediate the incident. Where required by applicable law, we will notify affected individuals and/or the Data Protection Board of India within the applicable timelines. Any notice will aim to explain, in plain language, the nature of the breach, the personal data affected where known, likely consequences, steps taken or proposed by Akaya, steps you may take to protect yourself, and contact details for assistance.

We retain personal data only for as long as necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

When you request deletion of your account or personal data, we will delete or de-identify associated personal data, including birth details, chat Inputs and Outputs, and reading history, within 30 days, unless we are required or permitted by law to retain certain information for a longer period.

Account deletion: you may delete your account through the Application's settings where available or by contacting us. Deletion may result in loss of your profile, chart, readings, chat history, subscription-linked access, and personalization.

Marketing communications: if we send promotional emails, you can unsubscribe using the instructions in those messages. You may still receive non-promotional service communications, including security alerts, account notices, payment notices, legal notices, and policy updates.

Push notifications: if you enable push notifications, you can turn them off through your device settings or Application settings where available.

Consent withdrawal: where processing is based on consent, you may withdraw it using in-app controls where available or by contacting us. If you withdraw consent for personal data necessary to provide a feature, that feature may no longer be available.

Subject to applicable law, you may have the following rights as a Data Principal:

• Right to access information — a summary of the personal data we process about you and the processing activities we undertake, and information about Data Fiduciaries and Data Processors with whom your personal data has been shared, to the extent required by law.
• Right to correction, completion, updating, and erasure — subject to applicable legal exceptions.
• Right of grievance redressal — you may raise a grievance regarding the processing of your personal data (Grievance Officer details below).
• Right to nominate — you may nominate another individual to exercise your rights in the event of your death or incapacity.
• Right to withdraw consent — withdrawal will not affect processing already carried out before withdrawal.

Duties of Data Principals: you are responsible for providing accurate information, not impersonating another person, not suppressing material information, and complying with applicable laws when using the Application or exercising your rights.

You may exercise your rights by contacting us at eskandh@akaya.app. We may need to verify your identity before responding, and will use information provided for verification only for that purpose. We aim to respond to rights requests within a maximum of 90 days, unless a shorter timeline is required by law or a longer period is permitted due to complexity, legal requirements, or verification issues. If we cannot fulfill your request, we will explain the reason where required by law.

Akaya is intended for users who are 18 years of age or older. The Application is not directed to children, and we do not knowingly collect personal data from children. For the purposes of Indian data protection law, a child means an individual who has not completed 18 years of age. If you are under 18, you must not create an account or use the Application. If we learn that we have collected personal data from a child in a manner inconsistent with applicable law, we will take steps to delete the information unless legally required to retain it. Akaya is designed for astrology-led self-discovery and personal reflection. You may choose to ask Akaya questions about relationships, career, emotions, past experiences, personal growth, money, family, timing, remedies, or similar life themes. Please do not submit highly sensitive information that is not necessary for your reading, including medical records, emergency information, government identification numbers, financial account numbers, passwords, private information about other people, confidential workplace information, or legal case details. If you include such information in your Inputs, we may process it as part of providing the Service.

Akaya provides astrological readings, self-reflection content, and general-interest guidance. It is not a healthcare, mental health, therapy, legal, financial advisory, or investment advisory service, and does not provide medical, mental health, psychological, legal, financial, investment, tax, career, marriage, immigration, or other professional advice, diagnosis, treatment, or decision-making. Nothing in the Application is intended to assess, measure, diagnose, prevent, cure, or treat any physical or mental health condition.

If you have medical or mental health concerns, please consult a qualified healthcare provider. If you may be experiencing a medical, mental health, self-harm, or safety emergency, contact local emergency services or an appropriate crisis support service immediately. You should not rely on Akaya as a substitute for qualified professional advice.

Akaya does not use AI to make legal, employment, credit, education, housing, healthcare, insurance, financial eligibility, or similarly significant decisions about you. The Application provides reflective and general-interest astrological content only. You remain responsible for your own decisions.

The Application may contain links to third-party websites, services, app stores, payment processors, or platforms. We are not responsible for the privacy practices, content, or security of third-party services. Your use of third-party services is governed by their own terms and privacy policies.

We may create aggregated or de-identified information that does not reasonably identify you, such as statistics about feature usage, app performance, or general engagement, and use it for analytics, research, product development, safety, and other lawful purposes. Where we maintain information in de-identified form, we do not attempt to re-identify it except where permitted by law.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you as required by applicable law, such as by posting the updated Privacy Policy in the Application, updating the "Last Updated" date, sending an email, or providing an in-app notice. Where required by law, we will seek your consent for material changes. Your continued use of the Application after the updated Privacy Policy takes effect means you acknowledge it, to the extent permitted by law.
